TERMS AND CONDITIONS OF SERVICE & PRIVACY POLICY

By checking the acceptance box on a digital estimate, approving a proposal electronically, scheduling service, or allowing work to be performed, you (“Client”) agree to be legally bound by these Terms and Conditions (“Agreement”). This Agreement constitutes a legally binding contract between Client and Sensei Lawns of Colorado. These Terms apply to all services unless otherwise agreed to in writing.

TERMS AND CONDITIONS OF SERVICE

1. Service Agreement and Automatic Renewal

This Agreement applies only to the services specifically outlined in the approved estimate, proposal, or service plan. Any services requested outside the agreed scope shall be billed separately and may require written authorization prior to performance.

All service programs automatically renew annually. Between January 1 and February 28 of each calendar year, Sensei Lawns of Colorado will issue renewal notices outlining the upcoming season’s services and pricing. Unless Client provides written notice of cancellation at least fourteen (14) days prior to March 1, services shall automatically renew for the upcoming season under the same service structure as the prior year, subject to applicable price adjustments.

2. Scope of Work

Sensei Lawns of Colorado shall perform services in a professional and workmanlike manner consistent with industry standards. Services may include fertilization, weed control, pest control, soil amendments, irrigation monitoring, and related lawn care services as outlined in the approved service plan.

Service timing may vary due to weather, product labels, site conditions, or seasonal limitations.

3. Lawn Health and Results Disclaimer

Client acknowledges lawn care is a process and not an immediate or guaranteed result. Performance depends on soil, irrigation, weather, turf type, and prior maintenance history. No guarantee is made regarding immediate results.

4. Payment Terms and Credit Card Authorization

Client agrees to keep a valid payment method on file. Payment is due upon invoicing unless otherwise stated. Client authorizes charges for services rendered.

Failed payments may result in service suspension.

5. Service Completion and Delinquent Accounts

Invoices unpaid after 14 days are past due and may result in service suspension. After 30 days, accounts may incur late fees, collections action, or service termination. Client is responsible for all collection costs including attorney fees.

6. No Refunds and No Credits

All sales are final. No refunds or credits will be issued under any circumstances.

7. Cancellations and Rescheduling

At least 24 hours notice is required for cancellations. Late cancellations may be charged in full.

8. Irrigation and Property Conditions

Client is responsible for irrigation and property conditions. Sensei Lawns is not responsible for damage or poor results due to watering issues, pests, disease, or existing lawn conditions.

9. Hold Harmless and Limitation of Liability

Client agrees to hold harmless Sensei Lawns of Colorado from claims arising from conditions beyond its control. Liability, if any, is limited to the amount paid for the specific service.

10. Mediation

Disputes must first be resolved through mediation in Douglas County, Colorado.

11. Attorney Fees and Costs

Client agrees to pay all legal and collection costs if enforcement is required.

12. Governing Law and Venue

This Agreement is governed by Colorado law. Venue is Douglas County, Colorado.

13. Early Termination

Client may terminate with 30 days written notice. Early termination may include fees equal to one service visit. Outstanding balances remain due immediately.

14. Cancellation of Services

Cancellation must follow Section 13. Completed services remain billable.

15. Service Reapplication Policy

If a treatment issue is reported within 7 days, Sensei Lawns may reapply service at its discretion. No refunds or credits apply.

16. Acceptance of Terms; Electronic Authorization

By accepting electronically, Client agrees to all terms, authorizes services, authorizes payment methods on file, and agrees electronic acceptance is legally binding.

17. Force Majeure

Sensei Lawns is not liable for delays caused by weather, supply shortages, labor issues, or events outside reasonable control.
